Santa Cruz April 18: The national deputy We Antonio Franco, reported to the media, Supreme Decree No. 29519 signed by President Evo Morales Aima, which is to regulate competition and consumer protection against harmful behaviors that adversely affect the market, prompting speculation on price and quantity, through appropriate mechanisms to be implemented by the Bolivian Institute of Metrology and the Superintendency of Companies.
In Article 2 Scope, explains that natural persons or legal entities, except those that are already regulated by law, to develop economic activities or non-profit organizations in the country, are obliged to bound by this Supreme Decree. Consequently, failure to comply will result in the application of coercive sanctions under the responsibility of the authorities.
In addition to in Article 3 Definitions, said that for the purposes hereof, means the operator, any person or entity, whether public or private, or nonprofit, which offers or demand tangible or intangible, or services in the market and unions or associations that group together.
For consumers or users, natural or legal person to acquire, use or enjoyment of lawful products and services trade, as their final destination, meaning those who used it for personal, family or your immediate social environment. Consequently, there are consumers who, without becoming final target, acquire, store, use or consume products and services to integrate into production processes. Finally
"Tonin" Franco said of the decree that the reasonable consumer, consumer is one that is shared in a timely way according to the circumstances in harmony with the principle of good faith. Supplier shall be any person, natural or legal person who is engaged regularly or in premises open to the public to manufacture, transport, market, distribute, sell, pack, or provide goods or services to consumers in exchange for financial reward.
Vaca Franco noted that the Decree is also referred to the competent authorities, or concerning the powers of the Bolivian Institute of Metrology, which will be the technical body in all that concerns the defense of consumer rights in areas incumbent. Similarly on the sanctions, without prejudice to any criminal liability, as appropriate, those who violate the rules contained in this Decree and other supplementary provisions shall be subject to sanctions imposed by the Superintendency of Companies or by the Bolivian Institute Metrology.
